Breaking: BIA Publishes Final ICWA Rule [ICTMN]

New ICWA Rule


This Wednesday, Acting Assistant Secretary of Indian Affairs Lawrence S. Roberts announced that the Bureau of Indian Affairs has published an updated final rule in the implementation of the Indian Child Welfare Act. Under the new rule, all state courts in foster care, termination of parental rights, and adoption proceedings will be required to ask whether the child is an “Indian child” under the definitions articulated in ICWA. The rule also requires that “active efforts” replace “reasonable efforts” with the goal of reunifying the child with his or her family.
