Michigan Court of Appeals Rules on Agency Obligation to Address a Parent’s Known Disabilities

On Wednesday morning, Michigan’s Court of Appeals released an opinion in a case involving the termination of parental rights of parents with disabilities. The Court held that child welfare agencies have an affirmative obligation to address a parent’s known disabilities, even if their attorney doesn’t raise the issue. The opinion also defined what reasonable efforts and accommodations must look like.
